JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-06-2020 Heard Mr. Gautam Kumar Kejriwal, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Tatarpur P.S. Case No. 199 of 2019 dated 02.08.2019 instituted for the offences under Sections 363, 366 and 366(A) of the Indian Penal Code.

Mr. Kejriwal, learned counsel for the petitioner submits that from the 164 statement of the victim girl, it becomes very apparent that there was consensual/love relationship between the petitioner and the victim girl.

However, looking at the age of the victim which was less that 18 years on the date of the occurrence, I am not inclined to enlarge the petitioner on

Patna High Court CR. MISC. No.85506 of 2019(3) dt.15-06-2020 2/2 anticipatory bail.

Accordingly, the prayer for anticipatory bail is rejected.

However, if the petitioner surrenders before the court below and seeks bail, his petition shall be considered without being prejudiced by the fact that, the present petition has not been entertained.
