====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-01-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Kotwali P.S. Case No.894 of 2019/G.R. No.8302 of 2019 registered under Sections 399, 401, 402, 413, 414 and 120(B) of the Indian Penal Code besides Sections 25(1-b) a, 26 and 35 of the Arms Act.

The accusation is that on receiving secret information about gathering of 15-20 miscreants at the G.P.O. Golambar to make the plan to commit the heinous crime, the informant along with other police personnel reached there, then saw 5-7 persons sitting on the tempo and 4-5 persons standing near the tempo. On chase, 12 persons, including the petitioner were

Patna High Court CR. MISC. No.777 of 2020(2) dt.21-01-2020 2/2 apprehended. On search, the petitioner was found in possession of 20 pieces of currency notes in the denomination of Rs.50/- and from the tempo, a bag, containing knife, was also recovered. Learned counsel appearing on behalf of the petitioner submits that the petitioner, in the present case, is in custody since 08.10.2019. The petitioner is accused in one more case of similar nature, as detailed in paragraph-3 to this application, in which he is on bail.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No.894 of 2019/G.R. No.8302 of 2019. Out of the two sureties, one must be the close relative of the petitioner.
