JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Rupaspur P.S. Case No. 311 of 2018 registered for the offences punishable under Sections 406, 420, 341, 323 and 504/34 of the Indian Penal Code.

As per FIR, petitioner has taken Rs.24,25,000/- for sale of his house and has not executed sale deed in spite of the fact that informant asked him to execute sale deed. Submission of learned counsel for the petitioner is that no such sale deed was executed and for that informant has already filed a title suit which is pending before learned Sub Judge and the case is in the nature of civil dispute. Heard learned APP and learned counsel for the informant, who has submitted that petitioner has executed sale

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He has to surrender and pray for regular bail. This application is, accordingly, dismissed.
