JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-06-2020 The petitioners seek bail in anticipation of their arrest in connection with Belaganj P. S. Case No. 52 of 2015 dated 05.04.2015 instituted for the offences under Sections 147, 148, 149, 341, 447, 323, 325, 307 and 302 of the Indian Penal Code.

17 persons have been named in the F.I.R. as having assaulted the deceased.

The learned counsel for the petitioners submits that only three injuries have been found on the person of the deceased and there is a special reason for falsely implicating

These grounds do not weigh with the Court for grant of anticipatory bail in the case of murder in which the petitioners have been named in the F.I.R. as having assaulted the deceased.

The prayer for anticipatory bail is rejected. However, if the petitioners surrender before the court below and seek bail, the same shall be considered on its own merits, without being prejudiced with the fact that the present petition has not been entertained by this Court.
