Heard learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest in connection with Khanpur P.S. Case No.177 of 2019 registered for offences under Section 302/34 of the Indian Penal Code. It is submitted by learned counsel for the petitioners that final form has been submitted and the petitioners have been exonerated. He further submits that the matter regarding

Patna High Court CR. MISC. No.6095 of 2020(4) dt.28-01-2022 2/2 acceptance of final form is pending for consideration in the court below and no order has been passed till date. In that view of the matter, this application for anticipatory bail has become infructuous.

The application for anticipatory is permitted to be withdrawn.

However, if the court below takes cognizance against the petitioners then the petitioners will have liberty to file fresh anticipatory bail application in this Court.
