The petitioner in the present case is seeking regular bail in connection with Katra P.S. Case No.239 of 2018 registered for the offence punishable under Sections 363 and 366(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to dirty village politics. Learned counsel submits that the petitioner has not committed any offence as alleged in the First Information Report.

Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.3717 of 2020(2) dt.21-01-2020 2/3 wherein it is the submission of learned counsel for the petitioner that the victim girl has not alleged any overt act against the petitioner and all that has been said to be against the petitioner that he was one amongst the co-accused who had made the victim girl to sit on a motorcycle which was driven away by coaccused Rakesh Kumar and further submission that the coaccused Rakesh Kumar and Kamal Chaudhary have been granted bail by a learned coordinate Bench of this Court in Cr.Misc.No.50734 of 2019 as well as in Cr.Misc.No.11372 of 2019, let the petitioner above named be released on bail on furnishing bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIV, Muzaffarpur in connection with Katra P.S. Case No.239 of 2018, subject to the condition as laid down under Section 437 (3) Cr.P.C. as under:

(a) that such person shall attend in accordance with the conditions of the bond executed under this Chapter, (b) that such person shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected, and (c) that such person shall not directly or indirectly make any inducement, threat or promise to any person

Patna High Court CR. MISC. No.3717 of 2020(2) dt.21-01-2020 3/3 acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police officer or tamper with the evidence.
