The petitioner seeks regular bail in connection with Palanwa P.S.Case No.122 of 2018 instituted for the offences punishable under Section 394 of the Indian Penal Code. Petitioner is not named in the FIR of the occurrence of robbery. Petitioner is in custody since 17.07.2019. Submission is that the petitioner was never put on test identification parade during investigation which is already complete now and not incriminating article was recovered from the possession of the petitioner.

Considering the fact that there is no material against the petitioner and there is no allegation that the petitioner is going to tamper with the evidence or abscond the process of

No. 87185 of 2019(2) dt.14-01-2020 2/2 law, let the above named petitioner be released on regular bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxual at Motihari, East Champaran in connection with Palanwa P.S.Case No.122 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner and also that the petitioner shall not leave the country without permission of the Court.
