The petitioner seeks regular bail in connection with Gandhi Maidan P.S.Case No.215 of 2019 registered for offences punishable under Section 392 of the Indian Penal Code. Prosecution case is of forcefully taking the vehicle of the informant in which the driver was also sleeping at that time. Petitioner is not named in the FIR and later on his name transpired on the confession of the co-accused. Apart from that he is accused in seven other cases. Out of seven cases, four are of similar nature.

Submission of the learned counsel for the petitioner is that except the confessional statement there is nothing against him and he is in custody for more than eight months but in spite

Patna High Court CR. MISC. No.807 of 2020(3) dt.20-02-2020 2/2 of that he has not been put on TIP. Charge sheet has been submitted. There is no chance of tampering with the evidence. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Patna in connection with Gandhi Maidan P.S.case No.215 of 2019 with condition that after release he has to appear before the police station of his local area for a period of six months so that the police may watch the activities and his conduct, otherwise his bail bond shall be cancelled.

Let a copy of this order be communicated to the Sr.S.P., Patna for the needful.

With the above direction, this application is allowed.
