The petitioner, who is in custody, seeks bail in a case registered under Section 392 of the Indian Penal Code in connection with Ram Garharwa PS Case No. 300 of 2018. Allegation of looting cash is against un-named accused persons. Petitioner's implication in the instant case is on confessional statement of co-accused. His remand is after grant of bail in Sugauli PS Case No. 235 of 2019. The petitioner after his implication in the instant case has been made accused in other four cases detailed in para 3 of the petition. It is also submitted that there is no recovery from the petitioner to connect him with the occurrence and that there is
Patna High Court CR. MISC. No.85153 of 2019(2) dt.16-01-2020 2/2 no identification of the petitioner till date. He has been remanded in this case on 17.7.2019 and since then he is in custody.
Learned APP opposes the prayer for bail.
Considering the aforesaid submission prayer for bail of the petitioner is allowed.
Let the petitioner above named be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Raxaul at Motihari, East Champaran in Ram Garhwa PS Case No. 300 of 2018 subject to the conditions:- (I) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled. (Madhuresh Prasad, J) SNkumar/- U T
