The petitioner is languishing in custody for the offence punishable under Section 379 of the Indian Penal Code. After completion of investigation police submitted charge sheet under Sections 379/392 of the Indian Penal Code. The FIR of missing a four-wheeler is against unknown. During investigation name of the petitioner surfaced in the confessional statement of co-accused. Petitioner is in custody since 21.06.2019.

Submission is that the petitioner was never put on Test Identification Parade during investigation of the case. No recovery is there from the possession of the petitioner.

No.846 of 2020(2) dt.16-01-2020 2/2 Considering the fact that there is no substantial material against the petitioner for the purpose of consideration of prayer for bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Danapur P.S. Case No.347 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the Court.
