The petitioner seeks bail in anticipation of his arrest in connection with Kanti P.S. Case No. 200 of 2019, dated 19.03.2019, instituted for the offences under Sections 147, 148, 149, 341, 323, 302, 379 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

No.86315 of 2019(4) dt.03-07-2020 2/2 It has been submitted on behalf of the petitioner that he is not named in the F.I.R. and his implication in the present case is only on the basis of confession of one Md. Abid, who has been granted regular bail. Other co-accused persons of this case have also been granted regular bail by different Benches of this Court.

Regard being had to the fact that there is no direct evidence against the petitioner and he is a person of clean antecedent, he, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Muzaffarpur in connection with Kanti P.S. Case No. 200 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
