Petitioner apprehends arrest in a case registered for the offences punishable under Sections 506/34 and other allied sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner and other 100 to 150 persons are alleged to have locked the main door of the hospital and put impediment in the working of the hospital. They were protesting against the death of a girl who was being treated for snake bike and died during treatment.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Instant case is the counter blast of earlier case filed against the

Patna High Court CR. MISC. No. 1734 of 2020(2) dt.25-02-2020 2/2 informant of the present case regarding ill treatment and negligent act of the doctors. Petitioner has got no criminal antecedent.

Considering the facts of the case, let the petitioner, above named, in the event of arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Kadwa Police Station Case No. 217/2019 on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
