The petitioner is in custody since 06.12.2019 8 in connection with Complaint Case No. C-2/734 of 2019 for the offence registered under Sections 30 (A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but from the open place and only on suspicion, the name of the petitioner has surfaced in connection with the present case.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let
