Petitioner, who is in custody seeks bail in a case registered under Sections 20(b)(ii)(B) of the N.D.P.S. Act and Sections 224, 225, 353, 34 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act.

Informant who is the police officer has alleged in his self statement that on 15.11.2019 at 2:00 P.M. while he was on day patrolling duty he received an information that accused Sumer singh, Anil Singh, Law Singh, Yogendra Singh and Ravindra Singh have kept illicit liquor in their grocery shop as well as residence and also engaged in sale of Ganja and reached said place and shop of Sumer Singh was searched and from said shop 25 bottles of country made 300 ml. each was recovered

Patna High Court CR. MISC. No.85603 of 2019(2) dt.16-01-2020 2/3 and a Ganja weighing 400 grams was also recovered thereafter he was apprehended and articles were seized upon which Sumer Singh called other accused who came there with lathi and danda and forcibly forced Sumer Singh from police custody. It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case. Nothing has been recovered from his possession. It has been further submitted that similarly placed co-accused have been granted anticipatory bail by a co-ordiante Bench of this Court vide order dated 19.12.2019 passed in Cr. Misc. No. 84322 of 2019. Petitioner has no criminal antecedent and is in custody since 16.11.2019.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Nabinagar P.S. Case No. 304 of 2019 subject to the conditions that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.

(4) If the petitioner is found involved in similar nature of offences, after his release on bail the trial court shall take steps to cancel his bail bond.
