The petitioners apprehend their arrest in connection with Jehanabad Mahila P.S. Case No. 56 of 2019 for the offence registered under Sections 498(A)/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. The allegation of the informant, who happens to be the daughter-in-law of the petitioners no. 3 & 4 is that the accused persons including the petitioners herein have engaged
Patna High Court CR. MISC. No.85422 of 2019(2) dt.07-01-2020 2/3 in harassing and torturing the informant on account of nonfulfillment of the demand for dowry. The learned counsel for the petitioners has submitted that as far as the petitioner no. 1 is concerned, he is the cousin grand father-in-law of the informant while the petitioner no. 2 is a neighbour, the petitioner no. 3 is the father-in-law, petitioner no. 4 is the mother-in-law and the petitioner no. 5 is sister-inlaw of the informant. It is thus submitted that if at all anyone is having any complicity in the matter, it may be the husband of the informant and the petitioners are not having any complicity in the alleged occurrence and neither they have ever demanded dowry nor they have harassed the informant. It is further submitted that as far as the petitioners no.
3 & 4 are concerned, they are living separately and other petitioners are obviously not in touch with the informant. Lastly, it is submitted that the petitioners are having clean antecedents and are having deep roots in the society as well as they are not likely to flee away, either from the investigation or from the ensuing trial.
Patna High Court CR. MISC. No.85422 of 2019(2) dt.07-01-2020 3/3 and proper to grant the privilege of anticipatory bail to the petitioners herein.
Accordingly, the petitioners, above named, are directed to be released on anticipatory bail in the event of their arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad Mahila P.S. Case No. 56 of 2019 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.
