JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This is an application for grant of anticipatory bail in connection with Pasraha P.S. Case No. 119 of 2019, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Recovery of 153 liters of liquor from the pick-up van and petitioner happens to be the owner of the said vehicle. Submission of the learned counsel for the petitioner is that he was not present there and it is the commercial vehicle engaged by other persons.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground of recovery. Having heard both sides, in view of the submissions, made above, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the

Patna High Court CR. MISC. No.85695 of 2019(2) dt.22-01-2020 2/2 learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court, if possible to be disposed of on the same day.
