====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Shankarpur P.S. Case No. 129 of 2019 for the offenses under Sections 147, 149, 341, 323, 325, 307, 379, 385, 504, 506 of the Indian Penal Code.

In the instant case, case diary has been called for and perused the same. Learned counsel for the petitioner submits that there is no specific overt act alleged against the present petitioner. The petitioner is in custody since 22.10.2019. Considering the aforesaid material available on record, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of

No.86815 of 2019(3) dt.31-01-2020 2/2 the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Madhepura, in connection with Shankarpur P.S. Case No. 129 of 2019. However, it is made clear that the petitioner shall extend full cooperation for early disposal of the trial. In the event the petitioner fails to attend trial for two consecutive dates in the court below without any cogent reason, the court below shall be at liberty to cancel his bail.
