The petitioner seeks regular bail in connection with Sandesh P.S. Case No. 99 of 2019 for the offence registered under Sections 147, 148, 149, 341, 325 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding the accused persons having intercepted the informant whereafter they had assaulted him by rod and stick as also had engaged in gun shot firing. The learned counsel for the petitioner has submitted that the injury report would show that there is no fire arm injury and all the injuries are stated to have been caused by hard and blunt object. The learned counsel for the petitioner has further submitted that a general and omnibus allegation has been made against all the accused persons and no specific overt act has been alleged to have been indulged in by the petitioner herein. It is submitted that in fact the learned court below by an order dated 03.02.2020 passed in Bail Petition No. 111 of 2020, in the case of co-accused, namely, Sanjay Kumar @ Sanjay Yadav and others, has been pleased to grant the privilege of regular bail as far as five co-accused persons are concerned, hence it is submitted that the petitioner be also extended similar privilege of regular bail. The petitioner is stated to be having a clean antecedent and is languishing in custody since 13.10.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the fact that a general and omnibus allegation has been levelled against the petitioner and no specific overt act has been attributed to him as also there is no fire arm injury on the person of the injured, I deem it fit and proper to direct for release of the petitioner herein on regular bail.

Accordingly, the petitioner, above named, is directed

Patna High Court CR. MISC. No.1584 of 2020(4) dt.20-03-2020 3/3 to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional District and Sessions Judge, Bhojpur at Ara in connection with Sandesh P.S. Case No. 99 of 2019.
