JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-01-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Official Complaint No. C2A/12/2017 for the offenses under Sections 8,20 and 29 of the NDPS Act.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is a poor Khalasi and not owner of the vehicle carrying contraband. Considering the fact that the petitioner has no criminal antecedent and he is in custody for more than two years, the court is inclined to grant bail. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.1843 of 2020(2) dt.22-01-2020 2/2 satisfaction of the Additional Sessions Judge-I-cum-Special Judge (Excise), Vaishali at Hajipur in connection with Official Complaint No. C2A/12/2017, subject to deposit of Rs.50,000/- cash in the Court below and on deposit thereof the petitioner shall be released. The deposit of Rs.50,000/- shall abide by the final outcome of the pending trial.
The bailers shall be the family members of the petitioner.
