JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Madhepura (Bharrahi O.P.) P.S. Case No. 374 of 2019 for the offenses under Section 379 of the Indian Penal Code. Allegation against the petitioner is that he was involved in theft of motorcycle.

Learned counsel for the petitioner submits that FIR was lodged against unknown. The name of the petitioner figured on the confessional statement of co-accused Nitish Kumar. The petitioner is in custody since 1.10.2019.

Considering the fact that the petitioner was not named in the FIR and his name surfaced on the confessional statement of the co-accused, let the petitioner, above named, be
