2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 190, 103(1) and 81(2) of B.N.S.
3. The case of the prosecution is that the brother of the informant has paid Rs. 1 lakh to one Pintu Kumar but he did not return the same and due to which, dispute arose between them. It is further alleged that on 12.12.2024, all the FIR named accused persons including this petitioner assaulted the brother of the informant with sharp weapons due to which he sustained injuries and some nearby people brought him to the Sadar Hospital where, he was declared dead by the doctor.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the FIR, it is clear that there is specific allegation against Dipu Yadav and Chintu Yadav that they have assaulted with knife. The nature of allegation is general and omnibus against this petitioner. Learned counsel has further submitted that similarly situated other co-accused person has already been granted anticipatory bail by learned co-ordinate Bench of this Court vide Cr. Misc. No. 60926 of 2025. The case of this petitioner stands on similar footing. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 08.09.2025.
5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gopalpur P.S. Case No. 277 of 2024 on furnishing bail bond of
Patna High Court CR. MISC. No.3307 of 2026(2) dt.06-02-2026 3/3 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of J.M. 1st Class, Gopalganj.
