The petitioner seeks regular bail in connection with Garkha P.S. Case No. 603 of 2019 for the offence punishable under Sections 25(1-b)a, 26, 27 and 35 of the Arms Act. The allegation is regarding recovery of one loaded country made pistol from the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner has been suitably punished and inasmuch as he is languishing in custody since 29.09.2019. Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for

Patna High Court CR. MISC. No.85720 of 2019(2) dt.14-01-2020 2/2 release of the petitioner immediately upon completion of six months of his custody i.e. w.e.f. 29.09.2019 and further subject to such condition as may be imposed by the learned court of Additional Chief Judicial Magistrate XIV, Saran at Chapra in connection with Garkha P.S. Case No. 603 of 2019. The petition stands disposed of with the aforesaid observations and directions.
