Petitioner apprehends his arrest in connection with Sahebganj P.S. Case No.208 of 2019, registered for the offence punishable under Section 392 of the Indian Penal Code. The allegation against the petitioner as per the First Information Report is that the informant after collecting the money to the tune of about Rs.1,03800/- was going to deposit the same in the Fino Bank, Sahebganj and he was accosted by three persons riding on the motorcycle including the petitioner, who has been identified by the co-villager along with other accused persons. Mr. Alok Kumar Alok, learned counsel for the petitioner submits that out of three persons two have been taken into custody and no T.I. parade has been held by the police. In the case of other accused persons, they have been granted regular bail by this Court. Learned counsel further submits that the petitioner has falsely been

No.85780 of 2019(2) dt.19-02-2020 2/2 implicated in this case on the basis of alleged identification made by the co-villagers and submits that petitioner is social worker and has been been implicated in this case with oblique motive by the informant and others. Learned counsel further submits that petitioner has got no criminal antecedent.
After having heard learned counsel for the parties and taking into consideration the fact that the petitioner has got no criminal antecedent and he has been identified by the passer by who allegedly happens to be the co-villager of the petitioner, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist (West), Muzaffarpur, in connection with Sahebganj P.S. Case No.208 of 2019, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
