The petitioner seeks bail in connection with C-III241/19, registered under Section (a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is of recovery of 250 bottles, contained in a sack, each containing 200 ml, country made liquor from the motorcycle on which petitioner and one Vishal Yadav were found sitting.

Submission is that the petitioner is not the owner of the motorcycle rather the same is belonging to co-accused, Vishal Yadav. The petitioner has no criminal antecedent and is in custody since 20.09.2019.

Having regard to the facts and circumstances of the

No.141 of 2020(2) dt.20-01-2020 2/2 case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with C-III241/19 to the satisfaction of the Additional District & Sessions Judge II-cum-Special Judge, Excise, Siwan.
