The petitioner seeks bail in Barh P.S. Case No. 376 of 2018, registered for the offence punishable under Section 376/120(B) of the Indian Penal Code and sections 66(A) (F)/67(A) of the Information Technology Act.

Earlier vide order dated 14.01.2020, case diary along with report of current stage of trial was called for, and the same has been received. From perusal of report dated 21.01.2020, it appears that the charges were framed against the accused and the case has been running for evidence since 10.05.2019, but no witness has been examined on behalf of prosecution. The case is fixed for evidence on 31.03.2020. The trial may be concluded within six months.

Patna High Court CR. MISC. No.86177 of 2019(4) dt.18-03-2020 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

However, the trial court is directed to expedite the trial and conclude the same within a period of one year from today. If the trial is not concluded within the stipulated period, the petitioner, may renew prayer for bail.
