JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-01-2020 This appeal has been filed for grant of regular bail in connection with Raoun P. S. Case No. 116 of 2019, disclosing offences under Sections 341, 323, 379, 504, 506, 34 of the Indian Penal Code and Section 3(i)(r) of the SC/ST (Prevention of Atrocities) Act.

As per F.I.R. the appellant and other accused persons came to the door of the informant and asked the informant as to why he has came for serving of notice and against this appellant that he assaulted by lathi and danda and other accused persons of snatching Rs. 2,000/- from him.

Submission of the learned counsel for the appellant is that the whole allegation is false and concocted. He is in custody since 22.11.2019. Further submission is that the co-accused has been granted privilege of anticipatory bail, vide order dated

Patna High Court CR. APP (SJ) No.5724 of 2019(2) dt.06-01-2020 2/2 20.08.2019 passed in Criminal Misc. No. 3443 of 2019. Heard learned Special P.P. also.

Having heard both sides, considering the above submissions, made above, this appeal is allowed. The impugned order dated 26.11.2019 passed by the learned Additional Sessions Judge-I, Banka, is set aside. Let the appellant, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-I, Banka, in connection with Raoun P. S. Case No. 116 of 2019.
