The petitioner seeks bail in connection with Biraul P.S. Case No. 154 of 2018, registered for offence punishable under Sections 302 and 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case merely on the basis of suspicion and he has no concern with the alleged offence. The petitioner is in custody since 29.08.2019.

Learned A.P.P. appearing for the State opposes the prayer for bail and submits that petitioner is husband of the

Patna High Court CR. MISC. No.86564 of 2019(2) dt.22-01-2020 2/2 deceased and from perusal of FIR, it appears that petitioner along with co-accused persons have committed death of deceased due to non-fulfillment of demand of dowry. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I am not inclined to grant bail to the petitioner.

Accordingly, this application is rejected.
