The instant application for regular bail has been filed by the petitioner in connection with Banka(Barahat) P.S. Case No.600 of 2019 registered for the offence punishable under sections 399 and 402 of the Indian Penal Code and sections 25(1-b)A, 26 and 35 of the Arms Act.

As per allegation in the FIR, on secret information having been received a raid was conducted and five persons of which four persons sitting on the two motorcycles were caught by the police but one person siting on the third motorcycle managed to escape. It is stated that on search one live cartridge was recovered from the possession of this petitioner. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.85238 of 2019(3) dt.18-03-2020 2/2 that no recovery as alleged has taken place. He is in custody since 27.8.2019 and has no criminal antecedent. It is further submitted that other F.I.R named co-accused Lalu Prasad Gupta and Arbind Yadav have also been enlarged on bail by order dated 23.1.2020 passed in Cr.Misc. No.4163 of 2020 and order dated 06.02.2020 passed in Cr.Misc. No.7022 of 2020. The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above including the petitioner being in custody for more than six months, this Court is inclined to enlarge the petitioner on bail. Let the petitioner be enlarged on bail in connection with Banka (Barahat) P.S. Case No.600 of 2019 on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
