The petitioner is in custody since 26.11.2019 in connection with Kazimohammadpur (K.M.P.) P.S. Case No. 488 of 2019 (G.R. No. 2303 of 2019) for the offence registered under Sections 30(a) of the Bihar Prohibition of Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but from a Hut which is not belonging to the petitioner.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let
