1. Heard learned counsel for the petitioner and learned A.P.P. for the state.
2. The petitioner apprehends his arrest in connection with Ara Town P.S. Case No. 147 of 2017 dated 19.03.2017 registered under Sections 406, 420, 120B/34 of the I.P.C.
3. As per the first information report lodged by the Marketing Manager namely Krishna Kumar Singh alleging that he collected and deposited Rs. 47 Lakh in the account of the company on different dates through cheque promising a good return to the investors @ 4-10% per month. After collecting a huge amount from the investors the company was closed. The petitioner and the officials of the company misappropriated

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name has transpired during the course of investigation. The petitioner is stated to be the Branch Manager of Ara Branch of D.J.N. Group of Companies. She further submits that the petitioner has got no complicity in the matter and the owner and Directors of said group of companies are the main culprits who have swindled the money of innocent depositors. The petitioner was merely an employee working for monthly salary. For the same occurrence many F.I.R. have been lodged by the investors due to which in paragraph no.-3 a large number of cases as antecedent are mentioned. In another F.I.R. bearing Ara Town P.S. Case No. 150 of 2017 the petitioner has been granted anticipatory bail by a Bench of this court in Cr. Misc. No. 3991 of 2020.

Regard being had to the submission made by the parties, taking into consideration the fact that petitioner is not named in the F.I.R., he was working as Branch Manager and a Coordinate Bench of this Court has granted anticipatory bail to the petitioner in connection with Ara Town P.S. Case No. 150 of 2017 having similar allegation, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No. 147 of 2017 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anil Kumar Sinha, J) praful/- U T
