Patna High Court MJC No.5287 of 2019(2) dt.06-07-2022 2/3 restoration of Cr.W.J.C. No.1232 of 2019 which was dismissed for want of prosecution by this Court vide order dated 27.08.2019.

Learned counsel for the petitioner submitted that on 27.08.2019, the arguing counsel had met with an accident and has sustained fracture injury in his left leg. Thus, under the unavoidable and compelling circumstances, he could not attend the Court on that day as a result of which, the writ petition was dismissed for want of prosecution.

Learned counsel for the State does not oppose the prayer for restoration of Cr.W.J.C. No.1232 of 2019. Regard being had to the submissions made on behalf of the petitioner, the application is allowed. Cr.W.J.C. No.1232 of 2019 is restored to its original file.

Cr.W.J.C. No.1232 of 2019 After some arguments, learned counsel for the petitioner seeks leave to withdraw the present application with liberty to seek other statutory remedy available in law for the redressal of the grievances of the petitioner raised in the present application.

Leave is granted.
