JUSTICE SANDEEP KUMAR ORAL ORDER 17-01-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State and learned counsel appearing on behalf of complainant through video conferencing. The petitioner apprehends his arrest in connection with Complaint Case No. 409 of 2019 registered for the offences punishable under Sections 420/406/323/504/506 of the Indian Penal Code.
Learned counsel for the petitioner submits that basically this is a dispute with regard to some money and the petitioner has withheld Rupees Sixty Thousand which was paid by him for the repair of the vehicle used by the opposite party No. 2 for four months.
Considering the facts and circumstances of the case, no offence is made out against the petitioner and also taking into
Patna High Court CR. MISC. No.1980 of 2020(7) dt.17-01-2022 2/2 consideration the fact that it is a complaint case, the present anticipatory bail application is allowed.
Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Kishanganj, in connection with Complaint Case No. 409/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
