Patna High Court MJC No.5305 of 2019(3) dt.12-12-2023 2/2 ORAL ORDER (Per: HONOURABLE MR. JUSTICE P. B. BAJANTHRI) 12-12-2023 The present MJC application is filed for modification of the order dated 28.11.2019 passed in MJC No. 4080 of 2019.
2. Learned counsel for the petitioner submitted that MJC 4080 of 2019 is for modification of the order in judgment dated 18.07.2019 passed in LPA No. 243 of 2019. In all fairness, petitioner should have produced copy of the MJC No. 4080 of 2019 in order to ascertain what is the grievance of the petitioner and same has not been placed on record even after lapse of four years.
3. Further, question of modification of the order dated 28.11.2019 is not warranted. Modification of any judicial order is only in respect of typographical error occurred in the judgement/order itself. If there is any other error on the facts and legal issue committed in the order or judgement, appropriate remedy is in filing civil review petition.
