Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273 and 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Submission is that the petitioner was not apprehended at the spot when huge quantity of liquor was recovered from the orchard of Chonhar Rai. Petitioner has got no criminal antecedent.

Considering the fact that there is no substantial material against the petitioner nor there is any allegation of tampering with the evidence or abscond the process of law, let the petitioner, above named, be released on bail on furnishing

Patna High Court CR. MISC. No.86034 of 2019(2) dt.14-01-2020 2/2 bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bochahan Police Station Case No.319 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
