JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2019 Petitioner seeks bail in anticipation of his arrest in connection with K. Hat (Sahayak) P.S. Case No. 290 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 386, 379, 427, 504, 506 of the Indian Penal Code and Sections 25(1-B)(a), 26, 35, 27 of the Arms Act. As per FIR there is allegation that some accused persons tried to grab the property of the informant and petitioner is not named in the FIR but later on his name transpired during investigation.
Submission of learned counsel for the petitioner is that his name transpired only on the basis of information supplied by spy and, that too, after two months and no specific allegation has been attributed against him and he has no criminal antecedent.

In view of above facts and circumstances, let petitioner, in the event of surrender within a period of three weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with K. Hat (Sahayak) P.S. Case No. 290 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
