The petitioner seeks bail in Ramgarh P.S. Case No. 168 of 2019 registered for the offence under Sections 304(B)/120(B) of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

As per prosecution case, daughter of the informant was married with son of the petitioner on 26-06-2012 and it is alleged that due to non-fulfillment of demand of dowry, she was subjected to cruelty and finally, she was killed by the accused persons. Petitioner is mother-in-law of the deceased. It is submitted on behalf of petitioner that petitioner is a lady, who is aged about 65 years, and there is no specific allegation against her. It is further submitted that no offence under Section 304(B) of the Indian Penal Code is made out,

Patna High Court CR. MISC. No.85953 of 2019(3) dt.18-03-2020 2/2 since death of the deceased has taken place after seven years of marriage. It is submitted that husband of the deceased is already in custody. Petitioner is in custody since 14-10-2019, having no criminal antecedent.

Considering the aforesaid facts and circumstances as well as nature of accusation, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Kaimur at Bhabua in connection with Ramgarh P.S.
