JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 Petitioner seeks regular bail in connection with Chhatapur P. S. Case No. 145 of 2019 registered for the offences punishable under Sections 498A, 506 of IPC and Section 3⁄4 of Dowry Prohibition Act.

As per F.I.R. petitioner happens to be the husband of the informant and he has ousted the informant from the house. Submission of the learned counsel for the petitioner is that as a matter of fact, she was married with another person and she also claims that there is love affair with the petitioner, but he has not divorced the informant, as such, allegation under Section 498A of IPC is not made out against him. Petitioner is in custody since 19.08.2019. He is ready to co-operate in disposal of the trial.

S. Case No. 145 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
