The petitioner seeks regular bail in connection with Shrinagar (Pujaha) P.S. Case No. 58 of 2019 for the offence registered under Sections 413 and 414 of the Indian Penal Code. The allegation is regarding the petitioner along with one co-accused person having been caught by the Police with a motorcycle and upon being asked to produce the papers of the motorcycle, they could not produce the same.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he is having a clean antecedent. It is further submitted that the petitioner is languishing in custody since 29.08.2019. Lastly, it is submitted that the petitioner is ready and willing to deposit a

Patna High Court CR. MISC. No.86185 of 2019(2) dt.14-01-2020 2/2 sum of Rs. 10,000/- in order to secure the privilege of regular bail.

Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the petitioner and taking into account the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner herein immediately upon deposit of a sum of Rs. 10,000/- with the Nazarat of the Civil Court, West Champaran at Bettiah and further subject to such conditions as may be deemed fit and proper to be imposed by the learned court of Judicial Magistrate-1st Class, Bettiah, West Chamaparan in connection with Shrinagar (Pujaha) P.S. Case No. 58 of 2019.

With the aforesaid observations and directions, the present petition stands disposed off.
