JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Chanpatia P.S. Case No. 262 of 2019, registered for offences punishable under Sections 379 and 461 of the Indian Penal Code.

Allegation against the petitioner and others is of attempt to commit theft in the shop of the petitioner. It appears that petitioner was not arrested on spot, later on his name disclosed by the co-accused.

It has been submitted on behalf of the petitioner that he has been made accused in this case only on the basis of confession of co-accused and except that there is nothing against the petitioner. Further he has no criminal antecedent and has been in judicial custody since 13.08.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., West Champaran, Bettiah, in connection with Chanpatia P.S. Case No. 262 of 2019.
