The petitioner is in custody in connection with Madanpur P.S. Case No. 175 of 2019 for the offence under Sections 302, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the allegation of firing is against Manoj Sharma on the chest of informant's uncle Sudhir Yadav. He further submits that there is allegation that this petitioner has also resorted to firing, which caused injury on Mantu Yadav. The injury report of Mantu Yadav is not forthcoming on record. The petitioner is in custody since 16.08.2019. He further submits that there is land dispute between the parties and on account of the same occurrence took place and there is case and counter case. He further submits that

Considering the fact that the allegation of firing resorted to by the petitioner is on Mantu Yadav and not on the deceased, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 175 of 2019 with the condition that the petitioner on release will render his service as volunteer for a period of two months in dedicated Covid Hospital. He is required to report to the District Nodal Officer in the concerned region, who shall utilize his service in this pandemic.
