2. The defect(s) as pointed out by the office be ignored for the present.

3. The petitioner seeks bail in connection with Khagaria Muffasil P.S. Case No. 478 of 2022 registered for the offence under Sections 302, 120B, 34 of the I.P.C.

4. The petitioner is named in the F.I.R. and is in custody since 10.07.2025.

5. The allegation against the petitioner is to commit murder of the brother of the informant by causing fire arm injury where occurrence is alleged to be arising out of previous enmity.

Learned counsel appearing on behalf of the petitioner submitted that allegation as to cause fatal fire arm injury is specifically available against co-accused Pinku Yadav @ Madhav, whereas as per allegation the bullet fired by this petitioner could not hit Sanjay Yadav. It is submitted that considering aforesaid aspect and nature of injury similarly situated co-accused persons namely Phudan Yadav and Bogan Yadav have already granted bail by different learned coordinate Benches of this Court through Cr. Misc. No. 33333 of 2023 vide order dated 12.07.2023 and 57146 of 2023 vide order dated 08.09.2023. In this context it is submitted that as a matter of judicial parity this petitioner also deserves bail. While concluding the argument, it is submitted that petitioner found involved in two more criminal cases where he is on bail and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

8. In view of aforesaid factual submission and by taking note of fact that allegation qua causing fatal fire arm

No.7245 of 2026(2) dt.06-02-2026 3/3 injury is not available against this petitioner, coupled with fact as similarly situated co-accused persons have already granted bail by different learned co-ordinate Benches of this Court, where petitioner remains in custody since 10.07.2025, accordingly petitioner above named, is directed to be released on bail in connection with Khagaria Muffasil P.S. Case No. 478 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ III, Khagaria/concerned court, subject to the conditions as mentioned under Section 480(3) of BNSS.
