The petitioner seeks bail in anticipation of his arrest in connection with Town P.S. Case No. 147 of 2019 dated 17.02.2019 instituted for the offences under Sections 341, 323, 324, 354 and 34 of the Indian Penal Code.
It appears from the FIR that when the brother of the informant raised protest against the bad behaviour of the petitioner and others, he was assaulted. Five persons have been made accused in this case, out of whom some have been granted anticipatory bail. There is one case against the petitioner with respect to kidnapping of a girl but the learned counsel for the
Patna High Court CR. MISC. No.87041 of 2019(3) dt.23-06-2020 2/2 petitioner submits that marriage of the petitioner has been performed with the aforesaid girl. It has also been submitted that the reason for accusation against the petitioner is that he had at one point of time forbade the brother of the informant from driving his vehicle in a rash manner.
Regard being had to aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Town P.S. Case No. 147 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
