JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2020 The petitioner seeks regular bail in connection with Chiraiya P.S. Case No. 474 of 2019, registered for offences punishable under Sections 363, 366(A), 34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor daughter of the informant.

It has been submitted on behalf of the petitioner that now the girl has been recovered and except the allegation that she was taken by the petitioner, she has not made any allegation of overt act and further there was love affair between the parties and petitioner has been in judicial custody since 28.09.2019. Learned counsel for the State opposed the prayer for bail on the ground that the girl is minor.

Having heard both sides, considering the facts and

Patna High Court CR. MISC. No.7358 of 2020(3) dt.19-02-2020 2/2 circumstances, at this stage, I am not inclined to enlarge the petitioner on bail. However, once charge is framed, petitioner will be at liberty to renew his prayer for bail. This application is accordingly dismissed.
