JUSTICE PRABHAT KUMAR JHA ORAL ORDER 28-08-2020 Heard Mr. Rabindra Kumar, learned counsel for the petitioner, Mr. Raj Kishore Singh, learned Additional P.P. and Mr. Ravi Shankar Sahay, learned counsel appearing on behalf of O.P. No.2.

The petitioner apprehends his arrest in Complaint Case No.1656/2018 for the offences allegedly committed by the petitioner under Section 498(A) of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act. At the outset of the argument, learned counsel for both the sides submit that both the sides are ready to amicably settle the dispute and they have agreed for one time settlement

Taking into consideration the facts aforesaid, the petitioner is directed to surrender in the court below within six weeks from the date of receipt of this order and thereafter the learned court below shall enlarge the petitioner on provisional bail for six months on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Kaimur at Bhabua in connection with Complaint Case No.1656/2018, subject to the conditions laid down under Section 438(2) Cr.P.C. Thereafter the learned court below shall make efforts for resolution of the dispute between the husband and wife. If the husband and wife resolve their dispute amicably, the learned court below shall confirm the provisional bail granted to the petitioner. If the dispute between the husband wife could not be resolved, the learned court below shall pass order in accordance with law on provisional bail of the petitioner immediately after lapse of six months.
