2. The petitioners apprehend their arrest in connection with Ghanshyampur P.S. Case No. 63 of 2019, for offences under Sections 147/148/341/323/324/307 and 379 of the Indian Penal Code.
3. The prosecution case, in brief is that the petitioners are alleged to have assaulted the informant causing simple injury.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Petitioners have clean antecedent. Petitioner no. 1 is brother of the informant whereas petitioner nos. 2 and 3 are
Patna High Court CR. MISC. No.90756 of 2025(3) dt.26-02-2026 2/2 said to be nephew of the informant. Both sides receives injuries. There is case and counter case between the parties.
5. Learned APP for the State has vehemently opposed the prayer for bail.
6. Considering the above facts and circumstances of the case and the fact that the injury is found to simple in nature, this Court is inclined to grant privilege of anticipatory bail to the petitioners.
7. Accordingly, let the petitioners, above-named, in the event of arrest or surrender within four weeks from today in the Court below, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-III, Biraul, Darbhanga/ concerned Court below, in connection with Ghanshyampur P.S. Case No. 63 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973/ section 482(2) of the BNSS.
