2. The petitioner has prayed for bail in connection with Jai Rampur P.S. Case No. 72 of 2025 registered for the offence punishable under Sections 28(1-b)a/26 of the Arms Act and Section 317(5) of the B.N.S., 2023.
3. As per prosecution case, on 13.09.2025 the informant got secret information that co-accused Moti Kumar has brought a blue coloured stolen scooter at his house and has also kept firearm in the house. On the said information, informant along with other police officials reached near the house of co-accused Moti Kumar and saw one person sitting on the blue colored scooter. It is alleged that on seeing police team, said person managed to escape. Mahal chowkidar disclosed the
Patna High Court CR. MISC. No.1282 of 2026(3) dt.18-03-2026 2/3 name of Moti Kumar, who fled away from the spot. On search, one country made single barrel gun and one number plate, upon which Registration No. BR01FY3938 was mentioned. It is further alleged that one blue colored scooter was also recovered which was parked in front of house of co-accused Moti Kumar.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that the name of this petitioner has surfaced on the basis of confessional statement of co-accused namely, Moti Kumar. He also submits that nothing has been recovered from the possession of the petitioner. He further submits that similarly situated other co-accused namely, Dhannu Kumar has been granted bail by this court vide Cr. Misc. No. 82114 of 2025. The case of this petitioner stands on similar footing. Moreover, a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 15.09.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is
Patna High Court CR. MISC. No.1282 of 2026(3) dt.18-03-2026 3/3 inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sheikhpura in connection with Jairampur P.S. Case No. 72 of 2025.
