The petitioner seeks regular bail in connection with Gopalganj Excise Cae No.3/2011 Tr No.881 of 2019 registered for offences punishable under Sections 47(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 30 ltrs. of country-made liquor and mahua flower from the house of the petitioner.

Submission of the learned counsel for the petitioner is that the house is a joint house and in that house several persons are residing, he has been falsely implicated in this case, having no criminal antecedent and he is in custody for 1 1⁄2 months.

Patna High Court CR. MISC. No.928 of 2020(2) dt.14-01-2020 2/2 Petitioner is a lady and she undertakes not to tamper with the evidence.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ II, Gopalganj in connection with Gopalganj Excise Case No.3 of 2011 Tr. No.881 of 2019.

With the aforesaid observation, this application is allowed.
