The petitioner seeks regular bail in connection with Raushanganj (Bankey Bazar) P.S.Case No.172 of 2019 registered for offences punishable under Sections 304(B) and 34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased and there is allegation of dowry death.

Submission of the learned counsel for the petitioner is that the FIR itself shows that she was brought from Maike just one day prior and the postmortem report shows that the death is due to hanging. There is no allegation of demand of dowry or torture to the deceased. It is further submitted that the materials

Patna High Court CR. MISC. No.85489 of 2019(4) dt.28-02-2020 2/2 collected during the investigation shows that petitioner had gone for taking tuition and thereafter the occurrence took place . He is in custody since 28.8.2019.

Heard learned A.P.P. and the learned counsel for the informant, who has opposed the prayer for bail stating that inquest report and the description of the occurrence do not show that it is a case of hanging.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Raushanganj (Bankey Bazar) P.S.case no.172 of 2019. With the above direction, this application is allowed.
