JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-06-2020 Heard Mr. Mazharul Hassan, learned counsel for the petitioner and learned APP for the State. The petitioner, who is the husband of the deceased, seeks bail in anticipation of his arrest in connection with Pear P.S. Case No. 89 of 2018 dated 01.06.2018 instituted for the offences under Sections 304(B)/34 of the Indian Penal Code.

It has been urged on behalf of the petitioner that the mother-in-law of the deceased has been acquitted in the trial. Some of the other accused persons also have been granted bail in this case.

However, considering the fact that the petitioner has not surrendered to the process of law up till now, I am not inclined to enlarge him on anticipatory bail.

Patna High Court CR. MISC. No.85535 of 2019(3) dt.15-06-2020 2/2 Accordingly, the prayer for anticipatory bail is rejected.

However, if the petitioner surrender before the court below and seeks bail, the same shall be considered without being prejudiced by the fact that, the present petition has not been entertained.
