The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 498A/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
Vide order dated 24.11.2021, the petitioner was directed to bring his wife back to her matrimonial home within a period of one week from today and thereafter file an affidavit to this effect. The petitioner is also directed to keep his wife with full honour and dignity.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.411 of 2020(6) dt.04-01-2022 2/2 petitioner had gone to Sasural to take his wife but she refused to come back. He submits that the members of Sasural also made firing upon the petitioner when he was returning from Sasural. However, learned APP for the State opposes the prayer for bail and submits that petitioner has made wrong submission before this Court.
Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Madhuban P.S. Case No. 202 of 2019 pending before the court of the learned Additional Chief Judicial Magistrate-IV, East Champaran, Motihari.
